Biden’s Executive Order is Wrong and Unconstitutional!

If you’re here wondering “what the heck was that all about?” – you’ve come to the right place.

Context: President Joe Biden is implementing an Executive Order (“EO”) requiring all businesses with a hundred employees or more to mandate that their employees get vaccinated—or else those companies will suffer significant financial penalties.

We, the Libertarian Party of New Hampshire (LPNH), denounce this as a GROSS overreach of power and we oppose it on every level. We ask you to read why we oppose it (below) and to JOIN US NOW in the fight against this Fascist regime that is poised to steal freedom away from Americans across our country—including here in New Hampshire.

Live Free or Die. This is our state’s motto.

Some, we suppose, view it with a certain curiosity or as a droll catchphrase. But many of us in the LPNH truly believe in these words. Live Free or Die. This means, to us, we would rather DIE than live without freedom.

Freedom is sacrosanct.

Freedom is vital to our survival.

Freedom is the cornerstone of our lives and civilization.

Biden’s recent executive order – his mandate for businesses with greater than 100 employees to require vaccination – flies in the face of this freedom. We find this infringement on liberty particularly heinous for four (4) primary reasons. They are as follows:

  • Hubristic & Machiavellian. Biden has elected to exalt his will above individual choice—at any cost. Giving him every benefit of the doubt, Biden must believe that because his cause is “virtuous” or “moral” it therefore transcends individual liberty. But that is not so! Just because a leader believes something is ‘correct’ does not give that leader the right to impose his or her will on others. The ends never justify the means and might does not make right!
  • Unethical. In choosing to rule over others via fiat, Biden is breaking his oath to the people that he will preserve the sanctity of choice and freedom in our country. Many of us in New Hampshire still cling to the belief that freedom is a fundamental cornerstone for our way of life. It is unethical to usurp individual will and the individual liberty of a free people.
  • Fascist. Biden, in his hubris, has decided to go down the path so many failed leaders in world history have followed before him. It is a path of destruction, and it is fundamentally evil and wrong. Fascism is the use of power (typically by a dictator) in order to impose policy through methods involving blending the private and public sectors. Benito Mussolini said: “Fascism should more appropriately be called Corporatism because it is a merger of state and corporate power.” In this literal sense, Biden has turned himself into a Fascist (without hyperbole) by demanding corporations hire/fire employees and/or conduct their businesses and direct their employees the way HE decides. This is a dangerous precedent for our country, and this is undeniably unconstitutional meddling that’s being attempted; this Fascist maneuvering is reprehensible, against our principles, and morally outrageous!
  • Unconstitutional. If previous reasons fail to convince certain people that Fascism is wrong, surely this final point will fail to convince them as well. But our country does, at least on paper, have a guiding document which is supposed to specify what uses of the central government power are acceptable and what are not: The United States Constitution. There is NO constitutional authority granted for a sitting US president to dictate, by fiat (executive order) how a private company should hire/maintain its workforce. Period. Biden’s edict is blatantly unconstitutional. If for no other reason, each individual state in the Union (including New Hampshire) should choose NOT to acknowledge or enforce this Executive Order on Constitutional grounds. Furthermore, if the Federal Government chooses to move forward, unconstitutionally, then it is clear the Supreme Court ought to reject the constitutionality of this Executive Order. It is so abysmally unconstitutional, Biden and his staff should be embarrassed to have even proposed it. However, politics in the US being what it is, few even care what the Constitution has to say about limits of government power.
